Jalandhar, December 11, 2012: The Central Bureau of Investigation (CBI) has filed a chargesheet against the then Minister, Family Welfare as well as Cooperative of UP; the then Principal Secretary, Medical Health and Family Welfare of UP (an IAS Officer); and the then MD; the then Chief Engineer; Superintending Engineer and Assistant Engineer, all of Processing and Construction Cooperative Federation Ltd (PACCFED)  in the court of Special Judge for  CBI Cases at Ghaziabad (UP) for causing a loss of about Rs.16.93 crore in a case relating to alleged irregularities in the implementation of NRHM funds in Uttar Pradesh.

According the spokesperson of the CBI, the CBI had registered five Preliminary Enquiries relating to alleged irregularities in the execution and implementation of National Rural Health Mission funds in the State of UP since its inception in the year 2005-06 till November 2011 on the directions of Allahabad High Court, Lucknow Bench passed vide order dated 15.11.2012.

On the basis of the findings in one of the five PEs, a case was registered on 18.01.2012 u/s 120-B r/w 420, 465,468,471 IPC and u/s. 13(2) r/w 13(1)(d) of PC Act 1988 against an  IAS, the then Principal Secretary, Health and Family Welfare, Government of UP, Lucknow and others for cheating the NRHM funds in the upgradation 89 district level hospitals of Uttar Pradesh. A sum of Rs. 89 Crores @ Rs. 1 Crore (approx.) per hospital was approved for the year 2010-11 for upgradation of 89 hospitals.

The investigation revealed that the then Principal Secretary, Medical Health and Family Welfare, Government of Uttar Pradesh and Chairman of the Executive Committee of the State Health Society, NRHM (Uttar Pradesh) in criminal conspiracy with the then Minister for Family Welfare as well as Cooperative, Uttar Pradesh; the then DG, Family Welfare, Government of UP; four officials of PACCFED i.e. the then MD, Assistant Engineer; Superintending Engineer and Chief Engineer; a businessman and close associate of the then Minister of UP and a Director of Gajraula (UP) based private company hatched a criminal conspiracy with an intention to cheat the NRHM funds in the upgradation of 89 district level hospitals approved for the year 2010-11.

 In pursuance to the  criminal conspiracy, the said public servant abused their official position as public servants and awarded the work relating to installation of Modular OTs and AC units in 44 hospitals to Gujraula (UP) based private company of said businessman on the basis of false/forged documents, for which hefty commissions were allegedly paid to then Principal Secretary and then Minister of UP. After award of work orders in respect of 44 hospitals, the accused officials of PACCFED also released about Rs.16.93 crores to a Gujraula based private company without receipt of any materials/goods in any of the hospitals and showed in the records as if the payment was made against receipt of goods/materials.

Earlier, a chargesheet was filed against the then DG, Family Welfare (U.P); a businessman; the Gujraula-based private company and its Director on 30.05.2012. Further investigation was kept open against other accused persons.

 It is mentioned here that the above findings are based on the investigation done by CBI and evidence collected by it.  Under the Indian Law, the accused are presumed to be innocent till their guilt is finally established after a fair trial.
