Gurugram DTCP issues notices to 17 projects for not obtaining OC
The department of town and country planning (DTCP) of Gurugram has issued show-cause notices to 17 projects for not obtaining Occupation Certificate (OC) and are still partially occupied.
Gurugram, March 23 (IANS) The department of town and country planning (DTCP) of Gurugram has issued show-cause notices to 17 projects for not obtaining Occupation Certificate (OC) and are still partially occupied.
In the notices, district town planner (enforcement) R.S. Batth said, the builders have offered the possession of the flat/plot and units and even towers at the projects which have been occupied without obtaining OC, which is clearly in violation of the condition of approved building plans.
The builders, he added, had also violated the Haryana Development and Regulation of Urban Areas Act, 1975.
The developers have been directed to appear before the DTP's office by March 30 to reply to why action may not be initiated against them.
The notice further said section 3B of the Haryana Development and Regulation of Urban Area Act 1975, provides that "no person shall erect or re-erect building in a colony save in accordance with the approved plans and subject to such restrictions and condition as are contained in the license or as may be specified by the Government or the Director".
"The building has been occupied without obtaining OC, the department is also not aware of the Fire Safety NOC regarding the functionality of fire fighting system, Structural Stability Certificate i.e. about strength and safety of the structure, the fulfilment of environment guidelines etc, which are a prerequisite for the grant of OC for any building," Batth said.
They have violated the provisions of section 3B of the Act by way of unauthorised occupation with obtaining OC and the same is liable for penal action under Section 10 of the Haryana Development and Regulation or Urban Area Act 1975, he added.
