JUDGMENT: 3 years RI to 2 for cheating and forgery

Jalandhar, December 15, 2012  : The Special Judge for CBI Cases, Visakhapatnam convicted Sri Bhogyam Prasada Rao, the then Superintendent, Central Excise, Anakapalli, District Visakhapatnam  and Sri Pakalapati Ramachandra Raju, Managing Director of  M/s Sree Ram Enterprises (P) Ltd., Daspalla Hills, Visakhapatnam for using forged documents as genuine and cheating United India Insurance Company Ltd., Visakhapatnam and sentenced them to undergo three years Rigorous Imprisonment.
A case was registered on 07-11-2002 U/s. 120-B r/w. 420, 468 and 471 IPC and Sec.13(2) r/w. 13(1)(d) of PC Act, 1988 against Sri B. Prasada Rao, Superintendent of Central Excise, Anakapalli, Visakhapatnam District and Sri R.P. Ramachandra Raju, Managing Director of Sreeram Enterprises (P) Ltd., Waltair Main Road, Visakhapatnam and others on the allegations that during the year 2000, accused persons entered into a criminal conspiracy to cheat the United India Insurance Co. Ltd., Visakhapatnam to the extent of about Rs. 16 lakh in the payment of a fire accident claim of Sri R.P. Ramachandra Raju.  In pursuance of the said conspiracy, Sri R.P. Ramachandra Raju submitted false RT-12 for the 3rd quarter of the year 2000 to Sri B. Prasada Rao, Superintendent of Central Excise. Sri B. Prasada Rao accepted the false documents as genuine with antedate and convinced the then Assistant Commissioner of Central Excise that the figures submitted by Sri R.P. Ramachandra Raju, Managing Director, earlier, were correct.    
On completion of investigation, CBI filed Charge Sheet against Sri Bhogyam Prasada Rao, the then Superintendent, Central Excise, Anakapalli, District Visakhapatnam; Sri Pakalapati Ramachandra Raju, Managing Director, Sree Ram Enterprises (P) Ltd., Daspalla Hills, Visakhapatnam and Sri Tangeti Srinivasa Prasad Babu and Sri Nittala Sunil Kumar, both Surveyors of United India Insurance Company, Visakhapatnam (both Pvt. Persons) before the Court of Special Judge for CBI cases, Visakhapatnam U/s.120-B r/w.420, 468, 471 r/w. 468 IPC and Sec. 13(2) r/w. 13(1)(d) of PC Act.
After conducting regular trial, the Special Judge for CBI Cases, Visakhapatnam found Sri B. Prasada Rao and Sri Pakalapati Ramachandra Raju guilty of committing the offences and convicted them. The Court acquitted T. Srinivasa Prasad Babu and N. Sunil Kumar U/s 248(1) Cr.P.C. for the charges levelled against them.
