Meeting of District Level Micro and small Enterprises Facilitation Council held
In today's meeting, 31 cases were enlisted for adjudication through Arbitration
Ludhiana: 111th Meeting of Arbitration of District Level Micro and small Enterprises Facilitation Council was held today in which 31 cases were enlisted . The Meeting was chaired by Varinder Kumar Sharma ,Deputy Commissioner, Ludhiana. The above meeting was also attended by Neeru Katyal PCS , Land Acquisition Collector , Improvement Trust , Ludhiana as Nodal Officer , Nisar Ahmed Lead District Manager ,Ludhiana as Member of Council .
Rakesh Kumar Kansal, Member Secretary cum General Manager , District Industries Centre, Ludhiana apprised that special efforts are being made for amicable settlement of dispute and platform is provided to address the issues related to delayed payments of Micro & Small Enterprises as per provision of MSME development Act 2006. He further apprised that Conciliation proceedings shall be conducted on every Tuesday , whereas Arbitration proceedings shall be conducted on every Thursday .
The proceedings are preferably conducted through offline mode in which claimant and respondent shall be able to attend in person for amicable settlement of dispute, face to face through conciliation proceedings, yet special guidelines are being observed and adhered to maintain social distancing and to follow SOP guidelines to contain spread of covid 19 .
Even provisions have been provided to conduct online proceedings through Video call , for convenience of claimant or Respondent . Till date, District Council have received 1350 references out of which 258 has been disposed off /settled & Adjudicated.
Whereas Advocate Himanshu Walia member of District council, disseminated that stakeholders should take advantage of this quasi judicial Authority to procure the delayed payments and also apprised that the award pronounced by this District council , which is statutory authority sustains the status of Decree of The Court & sustains overriding effect . To appeal against the award the respondent has to remit upfront 75% amount of the total Award amount then only the court of Law may entertain the appeal as per provision of MSME Dev Act 2006.
In today's meeting, 31 cases were enlisted for adjudication through Arbitration. Four References were Dismissed on Merits & Four References were Admitted and their claim accepted not only for Pending Prinicple amount but also that respondent shall be liable to pay Interest three times at the rate as per guidelines of RBI as per provision of section 16 of MSME Development Act 2006 .
